Supply of Forklifts on Lease - Price Discovery  
1) 4 Nos - 5 Ton capacity forklifts with mast height of minimum 4.9 meters, No Driver Required, Continuous Operation, Location: Tube Mill (Sohar)
2) 1 No - 7 Ton forklift, No Driver Required, Continuous Operation, Location: MBM (Sohar)
3) 1 No - 5 Ton capacity forklifts with mast height of minimum 4.9 meters, Dedicated Driver Required, Location: Muscat (Yard)
4) 1 No - 32 Ton forklift, Driver Required, Heavy-duty handling, Location: Tube Mill (Sohar)  

Working Hours: 24 hours/day, as required by operations. Fuel: Fuel to be provided by Al Jazeera Steel Products Co. SAOG.  
Maintenance & Support:
- Preventive and breakdown maintenance, including regular servicing, shall be carried out entirely by the contractor.
- One set of tyres per forklift shall be provided by the contractor annually. - Maintenance checklist will be provided by the Company; it must be completed daily/weekly/monthly by the contractor.
- A full-time technician shall be stationed at Jazeera Steel premises at no additional cost to the company.
In case the technician intends to take leave, the vendor must provide prior intimation at least one week in advance. During such leave, the vendor shall ensure an alternative technician is deputed, who must possess a valid and authorized driving license approved as per company requirements.
  Availability and Working Hours: The Equipment shall be available for 24 Hrs a day and 720 Hrs considering 30 days, Drivers as per above
Ageing Factor: The supplied forklift shall have a maximum age of 3 years from the year of manufacture. Any machine older than 3 years shall not be accepted. Factors running hours of machines shall be declared by the Vendor/bidder for equipment healthiness.      
PENALTY STRUCTURE FOR NON-AVAILABILITY OF FORKLIFT:

Spare Forklift Requirement: In the event of breakdown of any forklift for more than 2 days, a spare forklift of equivalent capacity must be provided immediately.

INSURANCE:      Full insurance coverage for all forklifts to be arranged by the contractor. A copy of the insurance certificate must be submitted before commencement.
CONTRACT VALIDITY:      12 months from the date of commencement. Extension or cancellation subject to mutual agreement.
TERMINATION:
- Either party may terminate the contract with one (1) month prior notice or intimation. 
 - Frequently unavailable/breakdown of Forklift may lead for termination of the contract by the Company.
- In the event the Contractor enters liquidation, makes arrangements with creditors, or fails to comply with any terms of the Contract, AJSP reserves the right to terminate the Contract immediately, without prejudice to any other rights or remedies. AJSP may recover from the Contractor any losses, costs, or expenses incurred due to such default and may divert the work to another contractor at the Contractors risk and cost if performance is unsatisfactory or detrimental to AJSPs interests

PAYMENT TERMS: Payment will be made within 30 days of submission of valid invoice.
INTERPRETATION OF CLAUSE:   In case of disputes, the interpretation of any of the clauses or specifications, the decision of AJSP will be final and binding on the Contractor RECOVERY: -   In case of any damage of equipment/machinery due to negligence of contractor or any other reasons attributed to contractor, the decision of AJSP regarding the amount of recovery shall be final and binding. Recovery will be effected from the monthly bills and/or retention money if applicable. -    If forklifts are damaged due to improper handling by the Company, the cost of such damage shall be borne by the AJSP.
FORCE MAJEURE:
- Force Majeure means an event or circumstance or combination of events and circumstances beyond the reasonable control of the Party that wholly or partly prevents or unavoidably delays an affected Party in the performance of its obligations under this Contract, which, amongst other, include Act of God, Natural Calamity, war, financial disorder,  economic slowdown etc.
-  The Party unable to perform this Contract due to the effect of Force Majeure events may, after consultation with the other Party, extend the duration of this Contract by a period commensurate to the time actually lost due to the Force Majeure occurrence. The other Party shall not claim compensation for the loss thus incurred  
NO SOLICITATION: Neither party shall directly or indirectly solicit, hire, or engage the employees of the other party during the term of this contract without prior written consent.
Additional Details: VAT charges 5% shall be extra from the total price.
